Your Arizona license hearing deadline
Arizona's admin per se law says a hearing request must be received by the department within 30 days after the date of the notice, or the suspension becomes final. A served suspension order takes effect 30 days after it is served (Arizona Revised Statutes §28-1385).
Arizona administrative license suspensions
| Situation | Suspension | Source |
|---|---|---|
| Admin per se suspension (BAC over the limit) | At least 90 consecutive days | Arizona Revised Statutes §28-1385 |
| Eligible drivers after the first 30 days | Restricted privileges for at least 60 more days | Arizona Revised Statutes §28-1385 |
Restricted driving needs things like completed alcohol or drug screening and no qualifying prior conviction within 84 months; Arizona also offers a special ignition interlock restricted license on request (Arizona Revised Statutes §28-1385). Some DUIs are felonies in Arizona (aggravated DUI), for example a third DUI within 84 months, driving on a suspended license, or with a child under 15 in the car (Arizona Revised Statutes §28-1383 (aggravated DUI)).
The criminal case
Separately from the license case, the DUI charge goes through court. Penalties depend on your record, your test result, whether there was a crash and other facts. A local DUI attorney can tell you what's realistic in your court and whether options like a reduced charge or a diversion program are available.
