How much does a DUI attorney cost?

DUI defense fees vary a lot by state, by city and by how complicated your case is. Here's what drives the price and what to ask before you hire anyone.

What people report paying

In a Nolo reader survey of people arrested for a first-offense DUI, respondents paid an average of $1,900 in attorney fees and expenses, and reported an average overall cost of $6,500 once fines, higher insurance and other costs were added (Nolo / DrivingLaws.org reader survey). Treat these as a rough guide: your quote depends on your case and where it's filed.

What makes a DUI lawyer cost more (or less)

  • First offense vs. repeat: repeat and felony cases carry bigger penalties and usually take more work.
  • Plea or trial: a case that goes to trial takes far more time than one that is resolved earlier.
  • The license hearing: the administrative hearing about your driver's license is a separate proceeding with its own short deadline. Ask whether it's included.
  • Refusal, high BAC, accident or injury: each can add issues to fight.
  • Location: fees differ between cities, counties and states.

Flat fee or hourly?

Many defense lawyers quote DUI cases as a flat fee for a stage of the case (for example, up to a plea or up to trial). Whatever the structure, get it in writing and ask what's not included: expert witnesses, the license hearing, trial and appeals are common extras.

Questions to ask in a free consultation

  1. How many DUI cases do you handle, and in which courts?
  2. Will you handle my license hearing, and do we still have time to request it?
  3. What's included in the fee, and what costs extra?
  4. Who will actually work on my case and appear in court?
  5. What outcomes are realistic for a case like mine?
