Can you get a free DUI attorney?
Two kinds of 'free' help exist after a DUI arrest: a court-appointed public defender if you qualify, and free first consultations with private DUI lawyers.

Public defenders
The U.S. Supreme Court held in Argersinger v. Hamlin that no one may be sent to jail for any offense, misdemeanor included, unless they were represented by a lawyer at trial (or gave up that right knowingly) (Argersinger v. Hamlin, 407 U.S. 25 (1972)). In practice, if you're charged with a DUI that could lead to jail and can't afford a lawyer, ask the court about a public defender at your first appearance. Courts decide eligibility based on your finances.
What a public defender may not cover
Your driver's license is usually handled in a separate administrative process (DMV, DPS or a similar agency) with a short deadline, often before your first court date. Ask early whether anyone will handle that hearing for you, because missing the deadline can mean an automatic suspension. See license hearing deadlines by state.
Free consultations with private DUI lawyers
Many private DUI lawyers offer a free first consultation. It's a chance to hear how your case could go, ask about fees and payment plans, and check whether the license hearing deadline is still open. Bring your citation, any license suspension notice and your court paperwork.
Quick answers
Do I qualify for a public defender for a DUI?
It depends on your finances and whether jail is possible in your case. Ask the court at your first appearance.
Are free DUI consultations really free?
Many lawyers don't charge for the first consultation. Confirm when you book and ask what happens next if you hire them.
